£20,800 award for hidden cycling injuries

Our client, Hannah Moodie, was riding her bicycle and had stopped at a junction. When the lights turned green she started off, but mid-way across she was hit by a car's wing mirror.

The impact knocked her clean off her bike. Her obvious injuries included soft tissue damage to her face as well as sprains to the neck, shoulder and hip. She also sustained some minor head injuries, even though she was wearing a helmet.

There could be no dispute about who was to blame, so we set about confirming the extent of her injuries. Our expert medical opinion recommended osteopathy treatment, which we funded through interim payments. We then also compiled a detailed schedule of Hannah's financial losses arising from the accident.

The other side made an offer to settle of £6,000, but Hannah was still in some pain. If we accepted it and she developed other problems, we couldn't re-open her claim and go back to ask for more.

Shoosmiths advised her to wait until we had a better idea of her likely prognosis. Sure enough, our expert then confirmed that she had also injured her cervical spine and right sacroiliac joint. We arranged for further treatment and the other side increased their offer to £17,500.

Hannah was anxious to get closure and given that our experts thought it unlikely that she would have any further problems, we confidently proposed a figure of £20,000 plus fees for outstanding treatments which was accepted and paid in full.
