Stoke breast cancer patients missed in recall

Some breast cancer patients, treated by an Oncoplastic Breast Surgeon at Royal Stoke University Hospital Trust, who is currently under investigation, may not have been recalled and may not have their cases investigated.

The surgeon is subject to an internal enquiry and has been prevented from seeing patients since January this year.  The Royal College of Surgeons are conducting their own investigation.

The Trust wrote to affected patients at the time to inform them of the investigation, however Shoosmiths is representing a patient who was not contacted by the Trust about the investigation and she may not be the only one.

After attending a free advice clinic held by Shoosmiths, the 68 year old mother of two from Cannock contacted the Trust to express her concerns and has since received a response informing that her case will also be considered by The Royal College of Surgeons.

She said:

‘I was surprised and concerned that I wasn’t part of the initial recall.  With Shoosmiths’s help, I have had to raise the issue myself to be included in the wider investigation of the breast surgery treatment by the surgeon in question’.

Shoosmiths are now arranging their next local advice clinic and urge any patients who are concerned about their breast surgery treatment at the Royal Stoke University Hospital Trust , whether they have received a letter or not, to contact them.

The solicitor assisting the client, Sharon Banga, Associate at Shoosmiths comments,

‘There may be other patients that have not been recalled who should be included in the Royal College of Surgeon investigation. From my experience of dealing with similar hospital recalls, it is often the case that only a small sample of the affected patients are recalled at first instance and therefore it is important that patients come forward if they have any concerns.’
