Rehabilitation and pay-out award for injury at work

Our client Darren O'Neill suffered a machinery injury which left him unable to work and facing real concern about how he would continue to provide for his family.

On the day of his accident at work, Darren was driving a low-level order picker (a kind of fork lift truck used in warehouses) when the front wheel came off, causing him to crash into a barrier and injure his dominant right hand and wrist.

He struggled on because he had a mortgage to pay and a family to keep, but the pain became worse and he eventually couldn't work any longer. The financial hardship he faced put a considerable strain on him and his family.

His employer had failed in their duty under the Provision and Use of Work Equipment Regulations 1998 (PUWER) to ensure the equipment he was using was fit for the job it had to do and in a safe condition so Shoosmiths was able to secure an award which solved Darren’s financial worries and helped to fund the medical and rehabilitation care and support he required.

The story doesn't end there though. Darren was made redundant due to the closure of the depot so we arranged for him to see an employment consultant who was able to provide advice about business opportunities and any retraining he might need. Darren used some of his award to set up his own business.
