Shoosmiths obtained compensation for Mrs D when she tripped on an extension lead, fracturing her right elbow.

Fractured elbow case background

Mrs D was working in an office when she caught her left foot under an extension lead connected to a portable radiator.

The extension lead was hanging down from desks where it was plugged into a socket, and lying along the floor. It caused Mrs D to trip and fall forward, landing heavily on her right side. She put out her right arm to break her fall and as a result her right forearm and elbow took most of the impact.

As a result of her accident, Mrs D sustained a depressed intra-articular fracture to the right radial head of her elbow, as well as bruising to her right knee, which settled within a couple of weeks.

Mrs D was off work for about seven weeks following her accident, during which time all portable radiators in the office were removed.

The medical expert who instructed to examine Mrs D was of the opinion that the residual limitation in movement of her right elbow may be permanent, but would have no functional impact on its use. The medical expert also considered that there was a 40% risk of Mrs D developing osteoarthritis in her elbow joint within the next five years.
